Waiver of Liability, Assumption of Risk, and Indemnity Agreement

This Agreement is entered into by and between the undersigned ("Participant") and Lake Life Concierge, LLC, a Georgia limited liability company ("Company"), effective as of the signed below.

1) Services Provided

Lake Life Concierge, LLC operates a transportation and shuttle service that provides transport to individuals upon request and is subject to agreement on price and availability.

2) Assumption of Risk

Client acknowledges and understands that transportation services inherently involve risk, including but not limited to traffic accidents, acts of nature, injuries, or death. By signing this Agreement, Participant voluntaritly assumes all risk, known or unknown, related to the use of the Company's services. *

3a) Waiver and Release of Liability

In consideration of receiving transportation services from the Company, the Client, for themselves, their heirs, legal representatives, and assigns, hereby fully releases, waives, discharges, and covenants not to sue Lake Life Concierge, LLC, its owners, officers, employees, contractors, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be *

3b) sustained by the Participant while using the Company's services, regardless of whether such loss is caused by the negligence of the Company or otherwise, to the fullest extent permitted by law. *

4) Indemnification

Client agrees to indemnify, defend, and hold harmless the Company and its affiliates from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or resulting from the Participant's use of the services or breach of this Agreement. *

5) Mandatory Mediation

In the event of any dispute, claim, or controversy arising out of or related to this Agreement or the services provided by the Company, the parties agree to submit the matter first to a non-binding mediation before a mutually agreed-upon mediator located in Georgia prior to initiation any formal legal proceedings. The parties agree to share equally in the cost of mediation. *

6) Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles. Any legal action arising under this Agreement shall be brought exclusively in a court of competent jurisdiction located in Hart County, Georgia. *

7) Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. *

8) Entire Agreement

This Agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes all prior or contemporaneous agreements or representations. *

9) Acknowledgment

Client certifies that they are at least 18 years of age, of sound mind, have read and understood this Agreement in its entirety, and are voluntarily signing it. *
